Regulatory, Public & Administrative

The Magdalen Chambers “Regulatory, Public and Administrative Group” covers three main areas of law.  These are Planning and Environment; Highways and Rights of Way and Regulatory matters.

In all of these areas Magdalen Chambers have become the first choice to represent many Local Authorities, solicitors, businesses or members of the public.  Current members regularly appear in Courts and Tribunals across the South West and further afield.  Magdalen members pride themselves on being approachable and able to meet a variety of different client needs.  Whether acting for an individual unfairly treated by a public body or a public body being unfairly treated by Government Magdalen advocates will see fair play.

Members of Chambers are regularly instructed in Judicial Review matters by individuals, groups or on behalf of public bodies.

Planning and Environment

Chambers’ planning, environmental and highways team provides a national service that offers experienced barristers with proven expertise within this specialism. Members appear regularly in all manner of planning appeals.; whether High Court challenges, tribunals, planning Inquiries, call-in Inquiries and statutory planning appeals. Members of our team also assist in relation to compulsory purchase/acquisition and matters of local authority liability. Members maintain their position as sector-leaders through training, seminars and lecturing.

Highways and Rights of Way

Members of Chambers have acted in a number of high profile cases involving both Highway Law and Public Rights of Way.  Members have been recently instructed both for and against local Highway Authorities and can appear regularly in all manner of highway appeals, whether High Court challenges, tribunals, Inquiries,  and call-in Inquiries.

Members also regularly deal with all aspects of Public Rights of Way.  Whether a footpath, a bridleway, or a Byway Open to All Traffic, Magdalen members are familiar with this complex area of law and have considerable expertise whether in preserving, removing or varying such Rights of Way.

Regulatory

Chambers’ Crime and Regulatory team consists of experts at all levels of call and experience.  Members are regularly instructed to appear in the Magistrates and Crown Courts and the Court of Appeal, acting for both prosecution and defendants, with instructions received from local authorities, the CPS, HSE and other notable organisations.
