Tanya Jones was instructed by Pam Dosanjh Phillips of Spencer West LLP to act for the Claimant in respect of their claims against the Respondent.
Tanya successfully argued that the Respondent’s failure to extend the Claimant’s Work Trial period resulting in her dismissal, was contrary to section 20/21 of the Equality Act 2010. Further, she argued that the Claimant was dismissed for something arising from her disability in breach of section 15 of the Equality Act. Lastly, she argued the termination of the Claimant’s employment was unfair pursuant to section 94 and 98 of the Employment Rights Act 1996.
The Tribunal listed the matter for 14 days with the list of issues being reduced throughout but ending on 105 issues. Tanya had to cross-examine 12 witnesses for the Respondent over 6 days. The Tribunal concluded with Tanya giving oral submissions alongside her 41 pages of written submissions.
Employment Judge Broughton sitting with Members, Ms McLeod and Mr Rose held the Claimant is entitled to damages and a remedy hearing is to be listed.
