Tanya Jones was instructed by Nicholas Ferber of DPH Legal to act for the Respondent in respect of claims made against them by the Claimant. The claims were for a lack of written particulars of employment, automatically unfair dismissal, unfair dismissal, failure to follow the ACAS code, harassment, victimisation, protected disclosure detriment, breach of working time regulations, unlawful dedication from wages, and breach of contract.
Tanya successfully argued that the Claimant did not have continuous employment throughout the entirety of the period claimed, and there were multiple periods of separate employment. This meant the claim for a lack of written particulars for the previous periods of employment were out of time. She persuaded the Judge no protected disclosures was made, and the reason for the dismissal was gross misconduct. The allegations of harassment were held to either not have taken place or were wanted. There was no evidence of the Claimant working hours in breach of the working time regulations. There was no failure to follow the ACAS code as the actions of the Respondent were reasonable albeit not desirable.
The Judge dismissed all claims brought by the Claimant.
